Throughout the site, the terms “we”, “us” and “our” refer to Bharatiyam. Bharatiyam offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms & Conditions”, “Terms”), including our privacy policy displayed on our website and those additional terms and conditions and policies referenced herein and/or available by hyperlink. The following terms and conditions regulate the use of our online e-ticket booking and/or donation by you as a donor. and all legal transactions concluded in this regard.
Bharatiyam is itself the organizer and issuer of e-tickets for all the offered events including the “Ragas for Yamuna– COVID Care Concert”and hence, Bharatiyam alone is the contractual partner for all the donors thereof.
Access: Your payment and registration entitles you to gain virtual access to the event for which you have registered. All other costs associated with your attendance shall be borne solely by you, and Bharatiyam shall have no liability for such costs.
Use of Likeness: By participating in the event you acknowledge and agree to grant Bharatiyam the right to record, film, live stream, photograph, or capture your likeness in any media and to distribute, broadcast, use, or otherwise disseminate, in perpetuity, such media without any further approval from you or any payment to you.
Event Content: You acknowledge and agree that Bharatiyam, in its sole discretion, reserves the right to change any and all aspects of the event, including but not limited to, the name, themes, content, program, speakers, performers, hosts, moderators, hosting platform, and time.
Limitations on Use: By registering for a Bharatiyam event you agree not to sell, trade, transfer or share your access link/code/donor-card / e-ticket, unless such transfer is granted by Bharatiyam. If Bharatiyam determines that you have violated this policy, Bharatiyam may cancel your access, retain any payments made by you, report you to law enforcement authorities, and ban you from future events.
Disruptive Conduct: You acknowledge and agree that Bharatiyam reserves the right to remove you from the event if Bharatiyam, in its sole discretion, determines that your participation or behavior creates a disruption or hinders the event in any manner whatsoever.
Recording, Live Streaming, and Videotaping: You undertake to not record or broadcast any event organized by Bharatiyam, the copyrights of which exclusively belong to Bharatiyam and/or the creators of the relevant works as the case may be depending upon the contractual arrangements relating to such events.
Unethical/Non-Compliant Activities/Practices:Bharatiyam reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant activities or practices.
In addition to the requirements and prohibitions set forth hereinabove, Bharatiyam may, in its sole discretion, also exclude anyone for or participating in any event.
The presentation of the donation e-tickets on the website represents no legally binding offer, but a mere offer to purchase. The conclusion of contract emanates from the costumer by clicking the “procure/purchase/book button/place order button” during the online event booking process to participate in the fundraiser for the relevant cause. Before you click this button triggering the offer to contract thereby binding yourself, you will receive the possibility to correct possible typing errors and to change the entered data in the offer to contract during the order process.
After having sent the offer to contract by clicking the “procure/purchase/book button/place order button”, you shall receive an automatically generated order confirmation from Bharatiyam to the e-mail address / mobile number entered by you while providing your data. Thereby the transaction of donation between you and Bharatiyam is concluded. Thereafter, Bharatiyam will send an automated booking confirmation to you, provided that the ordered donation / e-tickets are available.
With delivery of this booking confirmation to the e-mail-address entered by you, the transaction between you and Bharatiyam is concluded and cannot be cancelled by you without Bharatiyam’s consent. If the payment made by you is insufficient or declined for any reason, Bharatiyam may refuse to allow you to access the event and Bharatiyam shall have no liability in that regard.
The order is processed by Bharatiyam, within 72 hours at the latest after receipt. If you do not receive a response from Bharatiyam within this time, you have to inform Bharatiyam at <<****>>and Bharatiyam shall immediately investigate the matter. If you nevertheless do not receive a booking confirmation for another 24 hours, you are entitled to withdraw from the transaction free of charge. This declaration of withdrawal is to be declared to Bharatiyam at <<****>>stating the date of order and the transaction number received with the order confirmation.
The booking confirmation contains the appropriate donation / e-ticket including a unique voucher number along with the order invoice as an attachment. The charges towards the fees for donatione-ticket (via credit card, PayPal account etc.) will be processed directly after the booking confirmation has been sent. The booking confirmation has to be checked by the customer immediately after receipt.
Depending on the event/transaction, the donation e-ticket is either directly valid as an admission ticket, or it is sent as a unique access code or link.
All donation / e-tickets shall be shared only at the e-mail address shared by you at the time of registration and hence, be sure to check your junk email box too in case any of your event email(s) are caught by spam filters. You will receive essential information for registered attendees electronically at the email address only. In addition, you will also be added to the event participant list for notifications of future events.
The donation / entry fees for the fundraiser event may be subject to GST, value added tax, or other taxes and duties which, if applicable, may be charged to you in addition to the fees payable towards the donation / e-tickets for the event.
Bharatiyam strives to provide you with the most productive and effective experience possible during the concert / auction / event, and as the same is a fund raiser for a case, no complaints with respect to quality shall be entertained. However, inputs for improvement of the future events ar welcome.
No cancellations are allowed since the event is a fund raiser for the casue. All receipts of donations either against e-tickets or general donations are final. No payments will be refunded or refundable in any eventuality.Please note that if you do not cancel and do not access the event, you are still responsible for payment.In no event shall Bharatiyam be obligated to refund all or a part of the fee.
If Bharatiyam is prevented from carrying out its obligations pertaining to the event as a result of any factor beyond its control, or such event cannot be Virtually conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”) Bharatiyam shall have the right to immediately terminate the affected event without liability and shall be relieved of its obligations towards you. If the affected event is terminated due to a Force Majeure occurrence before the start of the event, then Bharatiyam will reschedule the affected event and your registration fee will be applied to the rescheduled event.
All the information on this website is carefully checked and updated on a regular basis. Bharatiyam is not liable for the topicality, accuracy, completeness or quality of the information. This includes all data concerning the time and hosting platform of an event, visibility, program and line-up, execution and the quality of events.
The use of the content on this website for the customer’s or a third party’s own commercial purposes is prohibited.
